Napier Imminent ( Just Like The Town Park )

So as we carry on waiting for the "Napier Report" I thought I would take a look at who was holding the real power back in 2008.

Yes they all have a part to play, and, we must learn exactly what those parts were, but, as I have said before they all said they were getting advise.

This advice was coming from the Law Office. I have no doubt the ones making the real decisions were.

Now these two hold the real power in Jersey. There is no doubt that there is a huge story as to what went on behind the scenes between William Bailhache, Harper and Graham Power. Was this the man who was giving the advice.














And bringing up the rear is the Solicitor General Tim Le Cocq

Tim Le Cocq represented the Home Affairs Minister at Graham Powers Judicial Review. He is now the Attorney General

These were the Law/Lawless? people in charge when Graham Power was suspended on the 12th November 2008.

Here is an interview, from November 2009, with Deputy Hill on the subject of Graham Powers Suspension which was 12 months in at this time.






As I was browsing Hansard I came across the Former Chief Ministers Liberation Day Speech from 2008 where he mentions Kangaroo Courts with the Media.

Senator ILM did exactly that.

This is what Frank " Shaft International" said

When we look at the Napier Report, i hope and prey it hasn't been redacted to within an inch of its life like the Wiltshire Report.

I hope the Media ( JEP) does a proper Journalistic Job with it but I hold my breath.

You are right about the AG. The fact that a single person is able to wield so much power by choosing what cases can or cannot proceed to court is a mockery of a democratic process.

Everyone in Jersey should seriously take a look at the legal and judicial process currently in place. Dozens of complaints about M**** L**** and yet he still presides over the children's department like a teflon don. Apparently the AG didnt think there was enough evidence to secure a criminal conviction.

Might start my own Report

So give or take a couple of days Warcup was in post for 97 days up till Powers suspension

Gradwell was in post for 86 days

Now for the judicial review and i quote

""In August 2008, Mr Warcup, with the authority of Mr Power, commissioned the Metropolitan Police to carry out a review of Operation Rectangle, which was commenced in September and from which an interim report detailing their initial findings was issued on 10th November"'

So the first thing i would like to look at is this

The Met report was commissioned in september that gave them 71 days to put an interim report together.

Now im no expert in this but 71days to put even an interim report together in something as complex as the Historical Child Abuse investigation seems quite remarkable. And as far as i know Power Harper or even ACPO were not interviewed at this stage.

Again i quote the judicial review

On the evening of 11th November 2008, Mr Warcup and Mr Gradwell gave a briefing on Operation Rectangle to Ministers in advance of a media briefing which was to be given the next day, the purpose of which was to correct facts that had been inaccurately presented and which in their view created a real risk to future trials. They announced that the forensic recoveries did not indicate that there had been murders of children or other persons at Haut de la Garenne and nor did the police believe that the evidence indicated that bodies had been destroyed, buried or hidden at Haut de la Garenne.

Now all im doing is looking at the hard facts. Gradwell/Warcup gave a press conference on the 12th of november that resulted in the suspension of Graham Power . They had been in the island 97 and 86 days respectively and the interim report took 71 days.


And we know there are many flaws with that November press conference

This is from Lenny Harper & remember the original suspension of Graham Power involved a letter from Dave Warcup backed up by the Interim Met Report that shoud never be used in disciplinary proceedings.

I have found these Quotes from lenny harper about the met report that i think helps a little ..

Why,with all the complaints about M---- L---- ,did he not get suspended as a neutral act while the investigations were being carried out. Same with D---- W---- he just kept getting moved from one states department to another ,despite being taken in for questioning three times. I believe on the third occasion he refused to answer any questions at all. Now the States have created a little job for him at St Saviours Hospital ( I kid you not)

When good people like John Day , Simon Bellwood, Graham Power have all been suspended as a neutral , why have the two States employes mentioned not had the same treatment .
You have to ask yourselves what makes them so special, who is protecting them

How was this allowed to happen.

Just like the Wiltshire Report, its make it up as you go along time, Wiltshire is so heavily Redacted,was meant for disciplinary purposes,and was held a loft like some triumphant trophy.

Just to let people know and recap

On the 10th of november the interim Met report turned up taking 71days

On the 11th Mr Warcup and Mr Gradwell gave a briefing on Operation Rectangle to Ministers in advance of a media briefing which was to be given the next day

In the evening of the same day this happened and i quote the review

"" On that evening of 11th November 2008, Mr Power was on holiday and at home. He was telephoned by the previous Minister for Home Affairs { andrew lewis } to whom for convenience I will refer to as ”the Previous Minister”. According to the affidavit of Mr Power sworn on 5th January 2009, the Previous Minister invited him to come to a meeting at 11.00 a.m. the following day to discuss the content of the briefing given to the Previous Minister that evening. Whilst aware of the media briefing scheduled for Wednesday 12th November, Mr Power says he had no previous notice of a briefing for Ministers on 11th November.
Mr Power attended the meeting with the Previous Minister on 12th November, which commenced at around 11.10 a.m. Present were the Previous Minister, the Chief Executive to the Council of Ministers and the Head of Human Resources.
It is important to make it clear that the Court is not required to adjudicate on the events of 12th November 2008 and this summary given by way of background has been taken in the main from Mr Power’s affidavit and the documents disclosed by both parties. We did not have an affidavit from the Minister or Previous Minister dealing with these events and it is clear that certain aspects of Mr Power’s account are not accepted by the Minister.""


So Graham Power gets a call from andrew lewis on the evening of the 11th can you come for a meeting on the 12th at 11.10 am with andrew lewis bill ogley and HR. He has no warning of what's about to take place

"The Previous Minister [ andrew lewis } then handed Mr Power a letter dated 12th November 2008 headed “Disciplinary Code” in which he informed him that he had received a letter from the Chief Executive enclosing a copy of a letter he had in turn received from Mr Warcup on the 11th November concerning an interim report that Mr Warcup had received from the Metropolitan Police into the conduct of Operation Rectangle. Mr Warcup’s letter included extracts from the report from the Metropolitan Police and concluded that there are significant concerns about the command and control structures in place with regard to the inquiry and Mr Power’s role within that. Examples of those concerns were quoted from Mr Warcup’s letter as follows:-
““There are no specific terms of reference for Operation Rectangle – given the potential size, complexity and sensitivity of the enquiry, one would have expected a more precise terms of reference.
From a command control perspective, if ex DCO Harper was SIO then it raises the question of who supervised him at a strategic level.
There is no policy book dealing with forensic strategy which is a critical area in this investigation.
A major factor affecting the planning of Operation Rectangle was the decision to limit it to a single agency led investigation, e.g., Police only.”
In addition, the Deputy Chief Police Officer’s letter refers to concerns, including the following:-
“There is no evidence of a proper command structure having been put in place in relation to the HDLG investigation, with a designated Gold Commander responsible and accountable for the incident.
There is no recorded evidence of any strategic oversight and approval of tactical plans and enquiry parameters on the HDLG investigation.
Financial controls appear to have been weak with a lack of overall strategy and a lack of day to day control.”
The Previous Minister’s letter went on to say that having considered the letter from Mr Warcup and the pre-press briefing given the night before, the overall management of Operation Rectangle would be publicly called into question. In the light of this and in the light of Mr Power’s accountability under Article 9(3) of the Police Force Law, the Previous Minister had decided to invoke the Disciplinary Code relating to the Chief Police Officer. He considered that the issues raised in the report relate to alleged serious matters of performance and capability which could not be treated as something occurring in the normal course of events and could not therefore be dealt with on a personal level pursuant to paragraph 1.1 of the Code. He had asked the Chief Executive to investigate the matter in accordance with the Code. It would appear that Mr Power was not given a copy of Mr Warcup’s letter.""

It's the Law Officers, as you said in the main posting, Andrew Lewis got leagal advice, Ian Le Marquand, all the key players in the (illegal?) suspension of Graham Power QPM and related issues have been getting legal advice will the legal advisors be held to account?........Tom Gruchy will be turning in his grave.

Look you may feel strongly for what you are trying to stand for but comments like "Graham, Lenny & Stuart were Shafted for exposing Child Abuse" can only be described as complete and utter bollox. If thats so true then why have we got another trial next month and new charges since as just one example. Once you stop bull shitting yourself you may have something to say of real value that merits actual attention but until then claims like your version of Napier are unworthy of any attention outside your one track minded blog.

So, i take it that when Warcup started in September 2008 he straight away realized things were a miss with the Investigation.

Now, thats not to say Power & Harper were doing things wrong. Warcup came in with a different view, a UK policing view.

Now this is where it starts getting very strange & messy.

The Met "Interim" Report

Why was the Interim report requested, its very simple.

There was to be a Government change in November. Chief Minister Walker & Home Affairs Minister Andrew Lewis were leaving office, there was no time to loose,it had to be an Interim Report, or, run the risk of going it with just a letter from Mr Warcup, for even this lot, it was a huge risk.

Remember how the Incinerator was passed quickly through the states before the Government Changed,this is no different.

So before the Met have finished their review Mr Warcup calls in a favour from Mr Sweeting of the Met.

I imagine it went along these lines

" Sweeting dear boy i need something in writing,could you knock a little Interim Report together ASAP. I have a meeting with the Chief of Police and the Chief Executive."

So Sweeting knocks a little Interim Review together and thinks about next years holiday.

The morning of the 12 November all hell breaks loose.

Not only have they gone and suspended the Chief of Police in Jersey but the clowns are quoting my Interim Review.

Background:
Mr Power was suspended from duty on 12th November 2008 by the former Minister for Home Affairs, Andrew Lewis, who claimed that he had evidence relating to the management of the Historic Abuse Enquiry which justified action under the Disciplinary Code. His suspension was subsequently continued by the current Minister for Home Affairs, Senator Ian Le Marquand.

Mr Brian Moore, Chief Constable of Wiltshire, was appointed in December 2008 to carry out a disciplinary investigation and report to the Minister. Senator Le Marquand originally indicated that he expected Mr Moore to report to him by March 2009. Mr Power cooperated fully with the Disciplinary Investigation and at one stage provided a written statement of over 62,000 words.
No disciplinary action was taken in 2008.
No disciplinary action was taken in 2009.
No disciplinary action was taken in 2010.
No disciplinary charges were ever brought.
No disciplinary hearing was ever called.
The costs of the suspension and disciplinary investigation have been officially confirmed as exceeding one million pounds. In a recent written answer in the States the Minister for Home Affairs said that up to the end of May 2010 the cost of the suspension and disciplinary investigation had reached a total of £1,069,776. This figure does not include the costs of the time of the Civil Servants and Law Officers who have assisted the Minister. Costs will continue to rise both in relation to cover for the absence of the Chief Officer, and in connection with the enquiry into the suspension currently being carried out by Mr Brian Napier QC.

The suspension was controversial from the onset. In January 2009 the Connétable of St Helier, Simon Crowcroft, brought a Report and Proposition to the States requesting an independent review of the suspension before further expenditure was committed. The proposition was opposed by Ministers and narrowly defeated. In the summer of 2009 the suspension was the subject of a Judicial Review in the Royal Court, and on regular occasions since 2008 there have been questions and exchanges in the States.

In September 2009 Mr Power successfully applied to a Complaints Board hearing for the Chief Minister to be required to disclose information relating to the creation of the original suspension documents. The subsequent disclosure cast doubt on the truthfulness of the previous accounts given by Ministers of the suspension process.

Following a Report and Proposition from Deputy Bob Hill, the Chief Minister recently agreed to an independent review of the manner in which the original suspension was carried out, with terms of reference not dissimilar to those first proposed by the Connétable of St Helier in January 2009. That review is currently being carried out by Mr Brian Napier QC.

There have also been questions in the States regarding the length and cost of the investigation led by the Chief Constable of Wiltshire, with some specific questions focussed on the scale of expenses claimed for hotels, travel and meals.

At every stage Mr Power has denied any wrong-doing whatsoever in relation to the management of the Historic Abuse Enquiry or any other issue, and said that he would defend himself against any disciplinary action that was brought against him.
Mr Power has made the following statement in relation to the imminent abandonment of disciplinary proceedings

"I am obviously pleased this unnecessary and unjustified disciplinary enquiry is now to be abandoned. In common with everyone else, I am entitled to be presumed innocent until proven guilty. The abandonment of disciplinary proceedings after almost two years means that I can now be regarded as having been exonerated of all allegations. That is not a matter of opinion. It is an accepted principle of justice. In these circumstances it is inevitable that attention will now be focussed on the actions of those responsible for initiating and continuing my suspension. While it would not be appropriate for me to become involved in any political exchange, I remain willing to assist with any legitimate enquiry in respect of the actions of those concerned.”

The total cost to the Jersey taxpayers for the suspension of Graham Power must be more like £3m.

Cost of time for civil servants and states members in all associated time, the initial discussions, the in camera debates, the various questions, legal advice, the media stories, etc... plus Wiltshire, plus an extended Napier report, plus the follow up....., then I guess defending a case for constructive dismissal by stealth.

So when one wonders why school milk is no longer free, ask who is/was really behind the suspension of Graham Power and why?

How come Graham Power had no warning of what was going on. When you look at this closely there can only be one outcome with the Napier Repprt. What will happen is they will go for damage limitation page 5 of the JEP and not much else and play it all down.

The problem could be if Brian Napier recommends a committee of enquiry,or if Graham Power starts Legal Proceedings.
It was very strange when David Warcup handed his notice in and blamed it on blogs.

My guess is that it will be sometime yet.If it is critical, then there are serious legal matters to deal with first.

I know there is a lot going on with the Napier Report at the moment.

I will see what is says, and check it against what we already know. If Napier has done a first class proper job, for some, it wont be an easy read.

Well, What a day and where do we start.

VFC & SS BLOG have covered the days proceedings. Where does that leave us?

The thing that got my attention is this.

Deputy Hill has had the report for a couple of weeks so must know it inside out. He will look bloody stupid if the Napier report backs the original suspension, so we can say that it is critical

But what of the relevance to Stuart Syvrret

There must be something in it or why send the email.

I have always said it comes down to the original suspension only a complete bloody fool would have fallen for ILM'S Kangaroo court, even with the full JEP backing it was a Joke.

What we are also seeing is what happens when you don't have any Journalists with a free range. How many Scandals and what do we get, zero just nothing. We need some investigative journalism on this Island we are desperate for it, we need a media who is prepared to fight for the normal working class on this island.

We want the answers

And remember no matter what way it goes it was Team Voice fighting for the Truth

Rico - the important thing is that you have risen above it and not allowed these faceless, nameless cowards to get you down. Support you have, and will continue to get believe you me.

Nothing, just nothing, zilch, nada, nil, sweet FA from any of our local media. Just what is their problem? Deputy Hill sends out and e-mail - that is a FACT. Stuart sends out a Press Release - that is a FACT. Not disputed - a FACT.

Who, for what reason or why has this been supressed?

Silence in this instance is not golden.
