End of Year Blog - Part 1

All the Jersey Agencies who had responsibility for Children in Jersey over the Decades should be willing and able to help any forthcoming Committee of Enquiry.



There is no excuse for this not to happen




1. How have the Children's homes been run in recent decades?



2. What procedures were in place to recruit staff and how was the performance of staff monitored? Should other steps have been taken to monitor performance?



3. What measures were taken to address inappropriate behaviour  from staff when it was discovered, and if those measures were insufficient , what other measures should have been taken?



4. How did those in authority at political and officer level deal with problems that were brought to their attention?



5. What processes were in place to assess the performance of the homes and what action was taken as a result of any problems that were identified?



6. Were there any mechanisms in operation to allow children to report their concerns in safety and what action was taken if and when concerns were voiced



The above is taken from P19/2011 tabled by the former Deputy of St Martin Bob Hill.  They were his recommendations for the terms of reference for the Committee of Enquiry.   The former States Assembly voted through 1,2, and 5. How or why did they come to the conclusion that the other parts were not necessary? I find this amazing I really do.  I shouldn't be surprised at the voting in the States but sometimes you just have to sit back and say what the heck was that all about.



The other TOR that managed to sneak through was the amendment by Deputy Tadier which was;

As you can imaging Senator Bailhache is highly conflicted with the Tadier Amendment as it looks at the Law Office. These issues must be highlighted. We must also be noted that his brother William Bailhache was Attorney General in 2008. The Law firm Bailhache & Labesse represented the Abuse Victims of Blanche Pierre and the collapsing of their case. You can read more on this here;

As we come to the end of 2011 I will be publishing some of my old blog postings & having a look back over the Year. 



It has been a long and rewarding year. As you will be aware this is done in my spare time. The researching and investigative work is done in spare time. What we have uncovered is shocking. The Jersey Media have uncovered nothing apart from a press release over these past 3 years. They don't ask any questions that might  vindicate the actions of Graham Power, Lenny Harper and  the team that worked under them in exposing the decades of Child Abuse in the care homes of Jersey.



Why can that be? What is the real reason that the Jersey MSM suffered a lobotomy when it came to the Jersey Historical Abuse Enquiry? The facts and evidence speak for themselves. In the New Year I will be also having a very serious look at the the Toxic Edifice that is the Jersey Evening Post. This will be highlighted when I start looking at the work of outside Media Consultant Matt Tapp. If people thought their reporting of the BDO findings was nothing short of a disgrace then you will be further shocked next year. 



As we look forward to 2012 there will be no let up in  our Investigative work


Stuart Syvret will be out of Prison in January fully reseted and ready for his continued battles against our Judiciary. HIs work is all entwined with the Child Abuse Investigation and their paths will cross during the Committtee of Enquiry.


Decades of Abuse occurred and no one knew?



No one complained? 



No one approached the Police? The Media? The Health & Social Services?

Rico - you have done sterling work this year, exposing and uncovering, for which all those abused in the care of the States of Jersey should be held to account, even if they have not all been brought to justice.

Both yourself and VFC have done the work that the MSM should be doing, rather than paying lip service to the Establishment and it's attempts at 'cover-up'.

BDO should have been an eye-opener, and we have you and Trevor to thank for that. Indeed to anybody who is attempting to unravel this can of worms, this coming year should prove most interesting.

This COI MUST proceed with very wide ToR's. Anything less will not suffice, nor will Bailhache's involvement be tolerated.

Rico as you and VFC know there will be a blog solely dedicated to the Treasury Minister Philip Ozouf in 2012 who has a big part to play in everything you are reporting on and much else besides. It promises to be an eye opener and will compliment all you are doing. DON'T LET BAILHACHE NEAR THE COMMITTEE OF INQUIRY UNLESS HE'S GIVING EVIDENCE TO IT FOR THE ROLE HE'S PLAYED.

What if those at officer level were suspects in the Child Abuse Enquiry, had a Notice Of Disclosure sent by the Police to the States, remained in post while being investigated for Child Abuse and somebody reported Child Abuse to this person who is a potential Child Abuser themselves?

There are still so many questions that need answering before the Abuse victims/survivors can find something near closure and equally as many questions to be answered before Jersey's reputation can start to be repaired.

The State Media's involvement HAS to be looked at in the COE also.

I spoke with Stuart on friday. As far as I can say he is 100% ok. He was in very good spirits. We had a very good chat about the issues facing us in 2012 and about his legal battles.

Being in prison is not the best place to be but out of every negative there is a positive. He has no distractions from his work. What more can they throw at him in some hope that he will just give up and go away.

The Crown Office - Unfit To Prosecute me, Unfit For Purpose?
The Scottish Law Reporter publishes another disturbing story about the ongoing transparent bias displayed against me by the Crown Office, this time hinting at something even deeper- a possible conspiracy.

The reporter in question in the article is from the Scottish Sun.

Many similar instances of malpractice in this case have occurred, beginning with my exposing Elish Angiolini`s established misconduct in 2009 and 2010 as highlighted in previous blogs.

On 4th December 2009, Procurator Fiscal Stephen McGowan made a false statement about the involvement of Elish Angiolini in the Hollie Greig case. He has since made a false statement to an official investigation in regards to his statement in open court on 18th August 2011. Despite being asked to remove himself as chief prosecutor by my defence lawyers, he still refuses to go. He has also been served a citation to appear as a key witness for the defence. A further hearing at Stonehaven about this sole issue will take place on 21st December.

On the 12th and 13th February 2010, I was arrested and charged in Aberdeen and had my home in Cheshire raided, in which my entire defence was stolen and has not yet been returned to me. Of course, my computer was among the many items taken. Curiously, the father and brother of Hollie never even had their computers checked, which is standard police procedure when individuals are accused of serious sexual offences.

It tok sixteen months of evasions before Grampian Police provided a copy of the search warrant, to find that it had been signed by Sheriff Patrick Davies, a close associate of one of the accused.

My arrest was authorised by Elish Angiolini, the personi had earlier publicly exposed for malpractice whilst holding the office of Lord Advocate.

Sheriff Davies went on to officiate at four subsequent hearings, including one closed session on 30th April 2010, denying me the opportunity to campaign as candidate for te Aberdeen South constituency by making a provably inaccurate statement in one of his reasons for doing so.

On 13th April 2011, in open court, Procurator Fiscal Anne Currie misled Sheriff Valerie Johnston regarding witnesses she falsely and deliberately stated were suffering from trauma, in an attempt to procure a miscarriage of justice against me. She is currently subject to an official investigation as a result and has continued to lie to the investigator about the content of her statement.

Around this time, the Scottish Legal Aid Board were persistently attempting to deny me Legal Aid. A member of the Board is Douglas Haggarty QC, a convicted sex offender, who had been apprehended in a public toilet in Glasgow with a 17-year-old male prostitute. Such is the calibre of those in whose hands my freedom depends.

On the afternoon of 14th November 2011, six hours after the trial had begun, I was told that the prosecution had suddenly produced sixty-one witness statements, none of which had been disclosed to me and I have still yet to see.

Now we have the highly suspicious incident that took place on 15th November 2011, after my Senior Counsel had unexpectedly and inexplicibly suggested that I change my plea to guilty, just hours after being led to believe that the Crown`s position was hopeless.

Given its obligations to objectivity, balance and impartiality, do you think the Crown Office is fit to prosecute me?

UK police to investigate drugs bugging

Curtis Warren is appealing against his conviction
THE States police are to call in a UK force to investigate its own officers over the handling of the investigation into notorious drugs baron Curtis Warren.

The force announced the decision just moments after the final submissions were made in Warren’s appeal in the Privy Council in London yesterday.

With a two-month break expected before the Privy Council returns its verdict on whether the States Police overstepped the mark by bugging a hire car without permission, the police have announced that Hampshire Police have been asked to review their operation.

The review – to be conducted by a detective chief superintendent – will focus on tightening policies and procedures, and whether any officers should face disciplinary action over the build-up to Warren’s arrest three years ago.

Warren is serving a 13-year sentence for conspiracy to import £1m worth of cannabis into Jersey in 2007, but that sentence could be effectively quashed by the Judicial Committee of the Privy Council when it returns its verdict.

Hi Anon thanks for pointing that out. Here was the email I sent Senator Le Marquand about this issue. This was from a posting I did in November.

During questions without notice today you were asked a question from Deputy T Pitman about an investigation by South Yorkshire Police S/Y. The Investigation by S/Y Police, was I believe, into the conduct of newly promoted superintendent Andre Bonjour. Here are some extracts from former retired DSO Lenny Harpers affidavit.

As you can imagine the allegations are very serious in nature. There are far more details to this. I believe this will give you an idea as to what Deputy Pitman was referring to.

There has always been allegations of the 'SOJP' not pursuing allegations of abuse in the past. Im in no way suggesting that Mr Bonjour is guilty of any wrong doing or is guilty of any of the allegations labeled at him but in light of his recent promotion and the run up to the forthcoming Committee of Enquiry I believe it is of paramount importance that we know that S/Y Police fully vindicated Mr Bonjour of any wrong doing.


Superintendent Bonjour is also listed as sitting on the Jersey Child Protection Committee (JCPC). It goes without saying that there cant be any unanswered questions concerning his good character

I believe there is reference to this in Graham Powers sworn statement to Wiltshire. The report was concluded when David Warcup was DCO and he informed Mr Power that it was a "career changing event" for the officer concerned.


The reason for this email Senator is simple. No one likes to ask difficult questions. Not the majority of our elected politicians nor any of our State owned Media. These questions must be asked and full honest answers given. The issues are far to serious not to be addressed.


Deputy Pitman was right to ask you this today in the States.

Today a person was telling me how Lenny Harper "had become corrupt" with his meals in London etc. Once the truth had been explained they were horrified to find out that the JEP hadn't been completely above board with them.

Look at it like this, at 50p that's £3.00 a week to read chip paper that's full of property adverts from months before and just a few news reports that amount to nothing. You don't have to have digs at the JEP on this blog, believe me people are sick of it already.

I have started my research into my next postings and the first thing that comes to my mind is 'oh no, not again'. I kid you not.

We, at team voice have our work cut out in the New Year. We have another BDO on our hands. Some seriuos questions will have to asked, these will go all the way to the Law Office.

I can safely say that the fog is clearing, it has taken years but it's clearing. At this rate I will be writing a book myself about what I have been through these past years in search of the truth.

Some people say our ruling elite are stupid. I don't fully go along with that. What they did was good and clever their only problem being that they thought no one would ever bother asking questions simple as that.

The 'FSL' that plagued the states these past 3 years have been replaced by a new tribe. They are now called the;

"The Zombie Brigade"

You know what I mean.

The JEP's only guaranteed payment of £270,000 per year from tax payers, only pays 9 of their staff over the year, and this is at the Jersey average wage.
On top of this they have rent, print, paper, etc. to pay for.

The only way this roll of paper is going to survive....

It's pretty simple.

If you don't like what the JEP prints, why not take the advice you give to others who criticise your blog, and just stop reading it ?

Why you feel it necessary to try and harrangue and criticise others all the time, and to try and reshape people's opinions, is beyond me.

And incidentally Rico, these are FACTS.

Stuart lied on his blog - This was proved in court

Stuart harrassed and condenmed an man who is inncoent in the eyes of the law, and that individual is now taking legal action against the States and the police. It will not be long before he is also taking action against Stuart.

And for you to claim that you don't know the name of the individual concerned is bs, and you know it. Why not grow a pair and admit it ?

I'm sorry, but behind your veneer of 'trying to do the right thing' you are just like the rest of the VFC. Biased, actively and intentionally blind to the failings and misrepresentations of your fellow bloggers, and hell bent on being a destructive, rather than constructive force.

Don't read the JEP, and stop wasting our politicians, and thus our island's, valuable time on events that no longer matter to the 99.99% of people who employ ouor political leaders.

What im doing is very simple. Im not stopping until I feel it's time. I have raised some very important issues with Senator Bailhache and will continue to do so. All the politicians are my politicians, they represent me i help pay their wage. What have I got wrong? The Abusing of Children for decades in the Care of the SOJ was wrong plain and simply wrong. Those issues have not been addressed and never will be if things don't change

After Bailhache made his Liberation Day speech about what he chose to call the "so called child abuse scandal", a number of succesful prosecutions were made of local child abusers.

Following those prosecutions did Bailhache ever apologise for his comment?

Not in my thinking of the law. The person this is about was caught with plenty of incriminating evidence and even if he was proven not guilty of the main crime he was certainly guilty of posession of loads of items that he should not have been in posession of. He got away with all of that because the main crime was dismissed. that in itself is a disgrace.

It is akin to say me, if I owned a load of hand grenades but never used them. The police raid my home because I have been, lets say dealing drugs. I prove I have not been dealing drugs and so the fact I had hand grenades in my possesion is of no longer any interest.

If you think that the guy you are on about is so perfect then why not take a time out and think about the other items in his psession that he got away with. then think about what he could have used them for if he wanted to.

Have a think, then come back and give an answer. A thought out one not just your usual mindless trash.

THE Health Minister yesterday refused to say whether anyone would face disciplinary action over failures to stop a boy suffering abuse and neglect for more than a decade.

Deputy Anne Pryke faced the media yesterday after the publication of a damning report which looked at how many agencies failed the boy.

She said that lessons had and would continue to be learned, but would not say whether any action was being taken against individuals.

The serious case review, which was published by the Jersey Child Protection Committee – a body charged with overseeing child protection services, found evidence that the boy had been left prey to paedophiles in a home characterised by shocking abuse and neglect.

It made 32 recommendations and found that social services, the courts, the police, schools and other agencies failed the child, to a greater or lesser extent, for 12 years.

Deputy Pryke appeared at yesterday’s press conference as the chairman of the children’s policy group, a States panel charged with child protection. Fellow group members Home Affairs Minister Ian Le Marquand and Education Minister James Reed were also there.

I am a parent and I think Jersey is one of the safest places in the world to bring up kids so I find a lot of your claims baffling and even more so when I know neither you nor Stuart Syvret are even parents.
Maybe you can push yourself to answer some of these observations for a change rather than dodge them?

What laws has he broken? A motoring misdemeanor which was an oversight for a busy politician, and wouldn't have been discovered without the illegal raid - and a data protection 'offence' which he (and many others of us) believes to be a valid exception in the Public Interest but he has been denied the opportunity to present the evidence!

Liar? What has he lied about? I don't believe he's foolish enough to state anything on his blog unless he's certain of what he's saying, with evidence and witnesses to back it up, and guess what? Nobody has yet given him the opportunity to test it in court either!

Well as a parent I totally agree with you and we are lucky to be in this environment. Jersey is a great place to bring up kids.

What we have seen though is that, on occasions, when parents are not around to look after their children and the State has taken over that things have started to look rather unsavoury. And no one seemed to care.

Do you recall the graffiti found on a wall at HdLG? "xxx raped here .. who's going to save us?"

No mention of Tim Hanson ? Yet in tonight's JEP it is reported that he is fighting States Lawyers that are battling to keep an internal report on three very damaged young people secret .
If Hanson succeeds and gets his hands on this report , it will totally blow the lid on the failings of the Social Services department ' s children's service.

Rico - the article on Advocate Hanson's battle with the States lawyers acting for Ann Pryke over this very disturbing and sad story, makes for very damning and concerning reading indeed (tucked away on Page 8 of the filthy one).

It says everything that has been rotten about the failings of the H&SS childrens services department, and it is not small wonder that they do not want it disclosed.

I wish Advocate Hanson every success in obtaining this report. As he says their stance puts the Island at odds with European and English Law.

Again a law unto themselves.

Stuart Syvret's case against the Chief Minister and others has been struck out.

He tried to sue the States for damages, claiming public officials had engaged in a conspiracy against him when he was dismissed from the post of Health Minister in 2007.

He says they engaged in a plot to cover up child abuse in the island, which he was trying to expose, causing harm to his emotional and physical health as a result.

The judge said none of the defendants owed him a duty of care as a private individual and that he was the "author of his own misfortune".

He said Syvret was trying to bring a private claim against a public wrong, at a time when he, as a public person, possessed no greater rights than anyone else.

Jonathan Sumption QC also refused to authorise a judicial review- which would have subjected the powers of public authority to scrutiny- and ordered Mr. Syvret to pay the defendants' costs.

After the judgment Mr. Syvret said: "I've done my best, indeed I thought it was quite funny in a tragic kind of way that Mr. Sumption suggested in the judgment that the stress, the harm, the difficulty I had suffered in 2007 in trying to expose these child protection failures and being opposed by the civil servants was self inflicted upon me, that I needn't have done that work, therefore I had no claim, which I think sends a very terrible message to public officials, that essentially means anyone who's in my position needn't bother to doing their duty, need not bother taking on significant challenges in their job, because if it's difficult and bad for you to do that then that's just tough."

Mr. Syvret claims he had a legal obligation as Health Minister to investigate allegations of child abuse, but that he was intentionally obstructed by public officials from carrying out his duties.

1. Circumstances leading to the Serious Case Review

.1 The three oldest children of the A family were removed from home in February 2008, and Care Proceedings were commenced. During these proceedings,information was produced and considered in relation to the children’s care over many years, and to the involvement of welfare agencies with the family.

.2 Based on this information, the advocate for the three oldest children requested that the Jersey Child Protection Committee (JCPC) undertake a Serious Case Review (SCR). His referral referred to evidence (from the report of the

Just as Lenny Harper was intentionally obstructed from doing his duty as an investigating police officer. Lenny recieved death threats, remember?

It stands to reason that in 2007, when Deputy Martin asked Senator Syvret the question of how safe is child protection past and present, and he answered with its bad. She Deputy Martin should have stood by him because realistically she knew the answer.

Senator Kinnard was in the house at that time, she believed in Senator Syvret but chose to run.

Deputy Martin believed in Senator Syvret....

But chose to join the Establisment!?

It's not "The Establishment" that Stuart is against. Stuart Syvret is not an anarchist. It's corruption in authority that Stuart hates, not authority. He's been called a "Maverick", an unbranded calf, but a better description of him in my opinion would be a Cathartic.

Haut de la Garenne reporter arrested in UK police bribery investigation
THE former News of the World crime editor who wrote some of the most lurid stories during the Haut de la Garenne child abuse inquiry has been arrested by anti-corruption police.
Several national newspapers have reported that Lucy Panton was taken in for questioning on suspicion of paying officers for stories. The 37-year-old was detained during a dawn raid on her Surrey home at 6.15 am on Thursday.
She is the seventh person to have been arrested since the launch of Operation Elveden, a probe into allegations of bungs being given to police officers by journalists.
The investigation is running parallel to the police inquiry into phone hacking
In February 2008, it was one of Mrs Panton’s photographers who was found hiding in bushes at Haut de la Garenne in the days before former deputy police chief Lenny Harper went public about excavations at the former children’s children’s home in St Martin.
In July this year, Home Affairs Minister Ian Le Marqauand said that police, either in Jersey or from the UK, must have leaked information about the inquiry to the Sunday tabloid.
In July 2008, Mrs Panton wrote a story for the paper claiming that she had exclusive access to a ‘shock secret police report’ which revealed ‘youngsters there were murdered then burned in a furnace to cover up the atrocities’. The story ran with the headline ‘All Kiddie killers left were burned bones and 65 teeth’.
Just months before that story, Mr Harper who was leading the Jersey historical child abuse investigation, invited Mrs Panton, who is married to a Metropolitan police detective, to dine with him and other police officers at an exclusive London restaurant.
The meal at Sir Michael Cain’s Shepherds restaurant cost the Jersey taxpayer £699.
Early this year, Mr Harper said that there was nothing inappropriate about his relationship with the media. He said that he had taken Mrs Panton out to dinner to try and stop the News of the World printing wildly inaccurate stories.
He told the JEP in July ‘I seem to be the only cop in trouble for not receiving hospitality from the News of the World, but for actually using my hospitality budget to pay for dinner’.
He added ‘I have been on record many times, as was (former police chief) Graham Power, that we were very concerned about leaks to the media and made strenuous efforts to track the leaks down’.
No evidence has come to light of Mrs Panton paying any Jersey officers for information.
Mrs Panton was promoted from crime correspondent to crime editor of the News of the World in October 2005. She had joined the paper in September 2002.
A statement released by the Metropolitan police about the arrest on Thursday morning said’ At 6.15 hrs on Thursday 15 December officers arrested a woman on suspicion of committing offences involving making payments to police officers for information’.
